The formal framework for the publication of this site and the activities presented.

In accordance with Articles 6-III and 19 of French Law No. 2004-575 of 21 June 2004 on Confidence in the Digital Economy (L.C.E.N.), users of the jsprivate.io website are hereby informed of the identity of the various parties involved in its creation and ongoing operation.

The publisher operates independently, without forming a registered commercial company, within the framework of French law applicable to individuals carrying out a non-salaried activity on a personal basis.

The publication director, within the meaning of the French law of 29 July 1881 on freedom of the press, is Jules S., as publisher of the Site.

4. Design and Development

The Site was designed and developed in-house by the publisher. All graphic, textual and structural elements are the exclusive property of the publisher, unless otherwise expressly stated.

5. Nature of Activity and Regulatory Framework

5.1. Activity description

JS Private presents a personal trading strategy developed by the Site's publisher, applicable to the financial markets (indices, currencies, precious metals). This strategy can be followed by interested users via the native copy trading functionality provided by Blueberry Markets, a regulated broker.

5.2. Regulatory framework

Blueberry Markets is a broker regulated by the Australian Securities and Investments Commission (ASIC), the Australian financial regulatory authority, under license number AFSL No. 463 433. The regulatory framework for order execution, custody of client funds and the copy trading service is fully assumed by Blueberry Markets in compliance with ASIC requirements.

5.3. Important clarifications

The Site's publisher does not provide, directly or indirectly:

  • portfolio management services on behalf of third parties within the meaning of Article L. 321-1, 4° of the French Monetary and Financial Code;
  • personalised investment advice within the meaning of Article L. 321-1, 5° of the French Monetary and Financial Code;
  • order reception and transmission services on behalf of third parties within the meaning of Article L. 321-1, 1° of the French Monetary and Financial Code.

No funds, securities or financial instruments are entrusted to the Site's publisher by users. The brokerage accounts of users interested in the strategy are opened in their own name with Blueberry Markets, which is the sole custodian of assets and the sole regulatory contact for users.

6. Risk Disclosure

6.1. Capital loss risk

Investing in financial markets, particularly derivative products (Contracts for Difference — CFDs, currencies, indices, commodities), carries a high risk of capital loss. You may lose all or part of the sums invested.

6.2. Leverage

The use of leverage, common in derivatives markets, significantly amplifies both potential gains and potential losses. An adverse market movement, even of small magnitude, may result in a loss greater than the capital initially committed.

6.3. Past performance

The past performance of any trading strategy, including the one presented on the Site, is in no way indicative of future performance. No guarantee of results is given and none can be required.

6.4. Suitability and risk capacity

Before any investment decision or subscription to a copy trading service, the user is invited to:

  • assess their knowledge and experience of financial markets;
  • determine whether this type of investment is suited to their financial situation and personal objectives;
  • consult, where appropriate, an independent licensed advisor;
  • never invest sums whose loss would jeopardise their personal financial situation.

7. Intellectual Property

7.1. Publisher's rights

All elements accessible on the Site — texts, visuals, graphics, logo, graphic charter, structure, tree structure, source code — are the exclusive property of the publisher or its rightful owners, and are protected by current intellectual property laws, in particular Articles L. 111-1 et seq. of the French Intellectual Property Code.

7.2. Reproduction and representation

Any reproduction, representation, modification, publication, transmission, distortion, total or partial, of the Site or its content, by any means and on any medium, is prohibited without the prior written authorisation of the publisher. Any unauthorised use may constitute an act of counterfeiting punishable under criminal and civil law.

8. Personal Data and GDPR

8.1. Data controller

The data controller for personal data collected via the Site is the publisher, reachable at: contact@jsprivate.io

8.2. Data collected

The Site collects only the data strictly necessary for processing contact requests or applications, namely:

  • first and last name (or pseudonym);
  • email address;
  • free message transmitted by the user;
  • where applicable, information voluntarily provided by the user as part of their request.

No banking, financial or wealth-related data is collected via the Site.

8.3. Processing purposes

Data collected is processed exclusively to respond to contact requests or to assess applications to the strategy presented. No commercial, advertising or marketing purpose is pursued.

8.4. Retention period

Data is retained for the period strictly necessary to process the request, and for a maximum of three (3) years from the last contact, in accordance with usual retention periods for prospect relationships.

8.5. Recipients

Data collected is processed exclusively by the publisher. No data is transferred, sold or transmitted to third parties for commercial purposes.

8.6. Rights of data subjects

In accordance with Articles 15 to 22 of the General Data Protection Regulation (GDPR) and Articles 49 et seq. of the amended French Data Protection Act, users have the following rights over their personal data:

  • right of access;
  • right to rectification;
  • right to erasure ("right to be forgotten");
  • right to restrict processing;
  • right to portability;
  • right to object;
  • right to define post-mortem directives.

To exercise any of these rights, the user may write to contact@jsprivate.io by providing proof of identity.

The user also has the right to lodge a complaint with the French Data Protection Authority (CNIL) — 3 Place de Fontenoy, 75007 Paris, France — www.cnil.fr.

9. Cookies

The Site does not currently use any audience measurement, advertising profiling or third-party tracking cookies. Only cookies strictly necessary for the technical operation of the Site (light/dark theme preference, language choice) may be placed on the user's device. These cookies do not require prior consent in accordance with CNIL recommendations.

10. External Links

The Site may contain hypertext links to third-party sites (in particular to the broker's platform mentioned in section 5). The publisher exercises no control over the content of these third-party sites and disclaims all responsibility for their content, availability, or data collection practices.

11. Limitation of Liability

11.1. Site availability

The publisher endeavours to ensure the availability and accuracy of information disseminated on the Site. However, it cannot guarantee the absence of errors, omissions, or occasional interruptions due to hosting, maintenance, or force majeure events.

11.2. User decisions

The information presented on the Site is for informational purposes only. It does not constitute an offer of financial services, a solicitation to invest, or personalised advice. The user remains solely responsible for their investment decisions and the financial consequences thereof.

12. Applicable Law and Jurisdiction

This legal notice and the use of the Site are governed by French law. Any dispute or litigation relating to the interpretation or execution hereof shall, failing amicable resolution, be submitted to the exclusive jurisdiction of the French courts.

13. Modification of the Legal Notice

The publisher reserves the right to modify this legal notice at any time, in particular to adapt it to changes in the Site, the services offered, or applicable regulations. The version published online shall prevail.
